The warranty does not apply to products purchased in the United Kingdom, Great Britain and Northern Ireland, including its overseas territories such as Gibraltar, Bermuda, Anguilla, the Falkland Islands, the Cayman Islands and others.
1.3 The warranty is only granted to consumers who have purchased products for private use.
1.4 The guarantor and provider of the "Post-Accident Car Seat Replacement" service is BrandLine Group Sp. z o.o., Adama Kręglewskiego 1, 61-248 Poznan, Poland (hereinafter: the guarantor). The guarantor is registered in the Polish National Court Register (KRS) maintained by the District Court in Poznań, KRS registration number: 0000552768. Its tax identification number (NIP) is PL7822579840.
1.5 The guarantor can also be contacted by email at [email protected] and by telephone on weekdays from 8:00 a.m. to 4:00 p.m. on +48 61 222 29 79. Questions and complaints can be submitted to the Guarantor by post, email or telephone.
1.6 The buyer may terminate the warranty and the agreement for the "Post-Accident Car Seat Replacement" service at any time without giving reasons by notifying the guarantor of the termination by email, letter or telephone.
1.7 The guarantor is neither willing nor legally obliged to participate in dispute resolution proceedings before a consumer arbitration board.
2.1 Warranty – Protection provided by the manufacturer, ensuring that the product will be repaired or replaced or replacement parts will be supplied in accordance with the terms of this warranty. “Warranty” covers the 12-year warranty “Lionelo Protect” as well as the 24-months warranty “Lionelo”.
2.2 Product – products of the "Lionelo" brand covered by the warranty.
2.3 Buyer – a natural person who is a consumer and has purchased a product covered by the warranty.
2.4 " Post-Accident Car Seat Replacement " – a service whereby a Lionelo child seat is replaced with a new one in the event of an accident, in accordance with the provisions of section 6.
3.1 Entitlement to the 12-year warranty (“Lionelo Protect”) arises upon conclusion of the purchase contract for the product, provided that the buyer registers the product at https://lionelo-protect.com within 90 days of concluding the purchase contract.
3.2 Each product must be registered separately. Registration is considered complete when:
a) all required fields in the registration form have been filled in correctly and
b) the proof of purchase (scan, photo or electronic document) has been attached.
3.3 After successful registration, the buyer will receive an email confirmation that the registration process has been completed and the information has been verified.
3.4 Within 30 days of registration, the purchaser will receive a warranty certificate by email, provided that the registration was successful.
3.5 In the event of unsuccessful registration, the buyer will be informed of the refusal to issue the certificate and will receive an explanation.
3.6 The 12-year warranty (“Lionelo Protect”) is only valid for products that have been successfully registered within 90 days of the date of purchase. For products that have not been registered within 90 days of the purchase date, a 24-month warranty (“Lionelo”) applies from the date of delivery of the product, but this 24-month warranty expires if the product is registered within 90 days of the purchase date and the 12-year warranty comes into effect. All provisions of these warranty terms and conditions apply to both the 24-month warranty ("Lionelo") and the 12-year warranty ("Lionelo Protect"), unless they expressly refer to one of the two warranties. "Warranty" within the meaning of these warranty terms and conditions therefore refers to both types of warranty.
3.7. The warranty is free of charge.
3.8. The warranty is not transferable to other persons and expires if the purchaser transfers ownership of the product to another person. In the event of inheritance, the warranty is transferred to the purchaser's heirs.
4.1 The warranty covers only manufacturing and functional defects in the product. If screens have no more than 3 defective pixels, this does not constitute a warranty claim.
4.2 The warranty excludes the following cases:
a) mechanical damage and cracks caused by the buyer or third parties (however, see 6. for "replacement of child seats after an accident"),
b) damage caused by improper use or failure to follow the operating instructions,
c) discolouration of LCD screens due to natural wear and tear,
d) software of digital products,
e) textiles and plastics whose discolouration is caused by normal wear and tear,
f) Wear parts and components that are worn out through normal use.
4.3 The 12-year warranty (“Lionelo Protect”) is valid for 12 years from the date of delivery of the product to the buyer. The 24-month warranty (“Lionelo”) is valid for 24 months from the date of delivery of the product to the buyer.
4.4 The warranty does not limit or replace the buyer's statutory rights in the event of defects. The buyer may assert its statutory rights against the seller independently of this warranty if the product was defective at the time of delivery. These statutory rights are free of charge and independent of this warranty in terms of time and other aspects.
4.5 Consequential damages are not covered by the warranty.
4.6 The assertion of rights under the warranty is free of charge.
5.1 If a defect covered by the warranty is found, the buyer can submit a complaint to the guarantor using the complaint form on the guarantor's website https://en.lionelo.com/complaints.
5.2 The buyer will then be informed of the address to which the product should be sent. Shipping is carried out by the buyer and at their expense. The return of the repaired product, the delivery of replacement parts and the shipment of a replacement product are at the expense of the guarantor.
5.3 Complaints will be reviewed within 21 working days of receipt. If the complaint is accepted, it will be processed in the following order:
In order to continue using the warranty, the buyer must re-register the replacement product and submit the exchange receipt as proof of purchase.
It is clarified that there is no entitlement to a replacement product if the product can be repaired. It is also clarified that there is no entitlement to product repair if the defect can be remedied by the buyer themselves by installing the replacement parts supplied.
Upon delivery of the replacement product, the warranty period is extended by the respective warranty period (12 years for the 12-year warranty and 24 months for the 24-month warranty). The warranty period is not extended in the case of delivery of spare parts or product repair.
If an identical product is not available as a replacement product, the buyer will be offered a product with similar characteristics. If this is also unavailable, the buyer may request a refund or a purchase voucher for the original purchase price.
5.4 If the required replacement parts are not available and this extends the repair time, the buyer will be informed immediately of the delay and the new expected repair date.
5.5 In the event of force majeure, the processing time may be extended.
Force majeure refers to unforeseeable events beyond the control of the parties, such as natural disasters, wars, riots, official measures, epidemics, strikes or other circumstances that delay the processing of the complaint. The buyer will be informed of such circumstances and the new expected processing date.
6.1 Terms of service:
In order to use the " Post-Accident Car Seat Replacement " service, the buyer must register the product (child seat) at https://lionelo-protect.com within 90 days of purchase. Registration under the "Lionelo Protect" programme is sufficient.
In the event of an accident, the purchaser must provide a document proving the accident (e.g. police report) confirming that the seat was installed in the vehicle. All sensitive personal data, such as identity card numbers or health data, must be blacked out or anonymised. In addition, photos of the child seat involved in the accident must be submitted. The child seat involved in the accident must be disposed of by the purchaser.
The replacement child seat will be sent to the buyer at the expense of the guarantor.
The "Post-Accident Car Seat Replacement" service is offered for 12 years from the date of delivery of the product (the child seat). Replacement of the child seat does not extend the term of the service. After twelve years from the date of delivery of the purchased child seat, the buyer is no longer entitled to a replacement child seat after an accident.
Entitlement to replacement of the child seat only exists if the child seat was properly secured in the motor vehicle. In the event of accidents outside of motor vehicles, such as dropping the child seat while transporting it from the home to the motor vehicle, there is no entitlement to replacement of the child seat.
The incident is reported using the form on the guarantor's website.
https://en.lionelo.com/post-accident-replacement
The purchaser has 14 days from the date of the accident to report the incident. If the incident is reported more than 14 days after the accident, the purchaser is not entitled to claim replacement of the child seat from the guarantor.
The service "Post-Accident Car Seat Replacement" and the use of this service is free of charge.
6.2 Scope of services:
In the event of a reported accident, the Lionelo brand child seat will be replaced with a new seat of the same model.
If the identical model is not available, an equivalent model will be offered.
7.1 The personal data of purchasers will be processed in accordance with applicable laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
7.2 Detailed information on data processing is available in the privacy policy on the manufacturer's website.
